Judge reveals Belarus’ Constitutional Court powers

"We have created and adopted a unique legal document. It combines traditions and innovations, the rule of the people and unity of governance. Without false modesty, it can be called the Constitution of the Future," President Aleksandr Lukashenko said on March 4th, 2022 at a solemn ceremony at the Palace of Independence. A judge of the Constitutional Court, Olga Sergeyeva, explained what role the Constitutional Court plays in the application and improvement of the Basic Law.

“The Constitutional Court is the only body in the state that has the authority to monitor the compliance of regulatory legal acts in the state with the Basic Law. Its conclusions and decisions are final and are not subject to appeal and protest. The Constitutional Court directs the legislator and law enforcers to comply with the multifaceted content of the Constitution and the inadmissibility of distorting its provisions in regulatory legal acts. The updated Constitution establishes that control over the constitutionality of legislation is carried out on the proposals of not only the President, the chambers of Parliament, the Supreme Court, the Council of Ministers – as it was before, but also the Presidium of the Belarusian People's Congress, while the preliminary constitutional control of laws is carried out only under the President’s proposals,” Ms. Sergeyeva said.
